C&S Authors Article for Finnish Competition Law Association Yearbook 2020

Our Competition & Procurement team’s Associate Joona Havunen, Associate Trainee Anna Joutsi and Economic Counsel Andreas Slotte authored an article entitled ‘Common ownership – a Primer and Practical Framework for Assessment’ for the recently published 2020 yearbook of the Finnish Competition Law Association.

Common ownership refers to a situation where stock investors—usually institutional investors such as pension funds, insurance companies, or mutual investment funds—have minority holdings in companies that compete in the same relevant market. The purpose of the article is to contextualise some of the current legal and economic understanding of the anti-competitive effects potentially stemming from common ownership in addition to providing a framework for identifying and assessing the circumstances under which common ownership may lead to anti-competitive outcomes.
